Victims' Bill of Rights

  1. Be treated with fairness, respect and dignity.
  2. Be free from intimidation, harassment or abuse throughout the criminal justice process.
  3. Know when an offender escapes or is released from custody.
  4. Be informed and present for all critical stages of the criminal justice process.
  5. Be heard at bond reduction/modification hearing, the acceptance of a negotiated plea, or the sentencing of a defendant.
  6. Confer with the prosecution prior to disposition and be informed of the final disposition.
  7. Be informed of the status of any case and any scheduling changes, if known in advance.
  8. Inform the court, in writing or orally, of the harm the victim has sustained.
  9. Have the court order restitution for losses.
  10. Be informed of the victim's right to pursue a civil judgement against any person convicted of a crime against the victim.
  11. Be informed of and heard at any post-conviction hearing.
  12. Prompt return of property held as evidence.
  13. Be informed of the availability of financial assistance and community services.
  14. Be informed about what steps to take if there is any intimidation or harassment.
  15. Be provided with appropriate employer intercession services.
  16. Swift and fair resolution of the criminal proceedings.
  17. Be provided a secure waiting area during court proceedings.
  18. Be informed when an inmate is transferred to a minimum security or community corrections facility.
  19. Be informed when a defendant is transferred or released from a state hospital.
  20. Be informed of any rights under the United States Constitution or the New Hampshire Constitution.
